SuperDupe Terms of Service

1. Acceptance of Terms
By accessing or using SuperDupe’s services—including any intake forms, creative briefings, avatar-based video generation, or related AI content creation—you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
2. Services Provided
SuperDupe offers done-for-you content creation powered in part by AI technologies. This includes video scripting, avatar generation (via HeyGen), and post-production delivery.
We do not offer direct access to a software platform; our services are creative, consultative, and managed by our team.
3. Eligibility
You must be at least 18 years old and legally authorized to enter into binding agreements. If you’re using SuperDupe on behalf of a business, you affirm that you have authority to bind that entity to these Terms.
4. User Content & Ownership
You retain ownership of any content you provide to SuperDupe (“User Content”), including scripts, visuals, and likeness. You grant SuperDupe and its partners a limited, royalty-free license to use, modify, reproduce, and process this content strictly for the purpose of delivering the agreed-upon services.
Use in SuperDupe Marketing Materials
Unless explicitly requested otherwise in writing, you grant SuperDupe permission to feature final deliverables (e.g., avatar videos, branded content, testimonials) in SuperDupe’s own marketing, portfolio, pitch decks, or case studies. We will never use sensitive or confidential material (e.g., unreleased products, private scripts, data) without your prior approval.
5. Avatar and Likeness Processing (HeyGen Disclosure)
By submitting video, voice, or likeness data to SuperDupe, you authorize us to process that data via third-party providers such as HeyGen. This may involve:
- Generating a synthetic avatar using your biometric likeness
- Temporary storage of facial/voice data
- Optional AI model training (you may opt out)

6. Prohibited Uses
You may not use SuperDupe services to:
- Generate content without the consent of depicted individuals
- Violate privacy or IP rights
- Distribute misleading, violent, or fraudulent content
- Represent AI-generated content as fully human-made without disclosure
- Circumvent our creative process to resell or replicate outputs
7. Payment & Refunds
All services are pre-paid unless otherwise agreed. Refunds are not guaranteed and will be considered only in cases of non-delivery or service error. Subscription clients (if applicable) will be billed as agreed per contract or invoice. Stripe may be used as our payment processor.
8. Termination
We may suspend or terminate your access at any time if you violate these Terms or use our services in bad faith. You may also cancel your engagement with SuperDupe at any time. Termination does not affect your license to already-delivered creative assets.
9. Limitation of Liability
SuperDupe’s total liability to you shall not exceed the amount paid for services rendered in the 3 months prior to the claim. We are not liable for any indirect, consequential, or incidental damages, including misuse or third-party reliance on generated content.
10. Confidentiality
Any materials shared between you and SuperDupe that are not public (e.g., brand strategy, pre-launch materials) will be treated as confidential and not disclosed without permission.
11. Dispute Resolution
These Terms are governed by the laws of the State of California. Any disputes shall first be attempted to be resolved informally. If unresolved, they must be settled by binding arbitration in Los Angeles, CA. You waive class actions and agree to individual dispute resolution.
12. Revisions to These Terms
We may update these Terms from time to time. The latest version will always be available at superdupe.ai/terms. Continued use of our services after changes implies acceptance of the updated terms.
